SSD HEARING TODAY

Posted by Kelly Saffell ® , Dec 12,2001,12:51   Archive
I went to my SSD hearing this morning. My LTD carrier provided me with an attorney. The hearing was short - 15 minutes. The medical expert testified that I was disabled under Section so and so and the judge never even asked for testimony from the vocational expert or myself. It just so happens that the judge was diagnosed with beb many years ago. It turned out he had hemifacial spasm, had surgery, and is fully recovered. I was, however, thrown a curve ball I wasn't expecting. He told me if he approved me (and I'm 99% sure he is) that he was going to notify the Dept of Transportion and recommend that they suspend my drivers license. He said there was no way that I could drive safely and he wouldn't want to be on the road with me. I don't drive much as it is but I do take Cory to preschool, go to Morgan's school on occassion, go to church when Aron's on duty, and go to the grocery store - all of which are within 3 miles of my home. My attorney told me not to worry too much right now - doctor's testimony will carry more weight but I'm terrified. If it weren't for the kids I would be ok with it. I pray I can get a restricted licenses ( 5 miles from home in daylight) and not lose it altogether.

Kelly, how terrible that that Judge said that. I wonder if he drives or realizes the importance of that last shred of independance we have. I was so lucky when I went last week, I was not sure my eyes would cooperate but the only trouble I had was with the eye test. I guessed at the letters because they were VERY blurry. I told the examiner that I knew my prescription needed changing and I planned to get that done. That seemed to satisfy him. I did tell a story, he asked if I had a medical problem that would prevent my driving, I told him no. He had all my information on the computer and I held my breath because I wasn't sure if SSD had sent anything in.

I do not plan to drive but maybe on a good day when the Botox works I MIGHT be able to drive. Like one day in 6 months. Maybe you can get a restricted license - ask your lawyer what he thinks.

Joyce in NC where it is rainy and drizzley (is that a word) but I love weather like this becauses it is so good on my eyes.

Kelly,

Congrats on getting your SSD. That's great, but sorry the judge said that to you. It seems to me it's up to the driver's license examiner when he gives you the eye test. Doesn't this judge realize that we have our good days and bad days?

I got my SSD in 1998 without a hitch. It never ocurred to me that they would question my driving and thank goodness, they didn't. As a matter of fact, I renewed my license today and was a little nervous about it, but had nothing to worry about. I don't drive that much, but I don't want to give up my license. I don't know about you, but I seem to have better distant vision anyway instead of close up.

I wonder if the judge drives or for that matter, how he would feel if someone were to recommend he give up his license.

Good luck on this and let us know what happens.

Kelly:
I remember reading about a pilot with BEB who lost his medical license to fly and got it back when he proved botox was working for him. I'm sure he has good days and bad - even with botox working. If the feds let him fly, I can only hope the dmv will be as wise.
My husband would say - don't sweat it til you have to. Easier said than done.
Good luck and in the meantime, enjoy your precious little ones. What a happy time of year for them and for us who are lucky enough to play "Santa".

Hi Kelly,

Getting a judge who not only had heard of BEB, but actually HAD it, was sure a coincidence. But then the down side!! I hope he either forgets about pulling your license or agrees to your requesting a limited one from the DMV. Keep us posted.

Sally in North Idaho where we are predicted to get 3-5 inches of snow tonight ... and tomorrow is my BOTOX DAY!! If I have to cancel, the next time I can be rescheduled is after New Year's because my doctor is going to be out of the office!!!

Kelly,

Sorry to hear about the judge threatening to take away your drivers license. I really hope it will all work out for you. I hope your attorney can help you. That really was so cruel of him to do that to you. Good luck.
